1. Acceptance of Terms
By visiting spiceduplawnservice.com or go.spiceduplawnservice.com, submitting a request through our website, communicating with us, or using any Spiced Up Lawn Service LLC service, you agree to these Terms of Service ("Terms") and our Privacy Policy at https://spiceduplawnservice.com/privacy. If you do not agree, please do not use our website or services.
These Terms form a legal agreement between you ("you," "your," or "Customer") and Spiced Up Lawn Service LLC ("Spiced Up," "we," "us," or "our").

3. Our Services
Spiced Up provides lawn care and landscaping services, including but not limited to:
- Lawn maintenance: mowing, edging, trimming, blowing, and seasonal cleanups
- Landscaping: planting, sod installation, flower beds, and garden design
- Design: custom landscape design and installation
- Hardscaping: patios, walkways, retaining walls, and landscape lighting
- Irrigation: sprinkler system design, installation, and repair
- Drainage: French drains, grading, and water management
The specific services we offer, our pricing, and our availability are determined on a case-by-case basis after an on-site assessment of your property. Services are subject to change, and not all services may be available at all times or in all locations.
4. Estimates and Quotes
4.1 Initial Estimates
Any estimates provided through our website, over the phone, or via text message are initial estimates based on the information you provide. They are not binding and are intended to help you understand the typical price range for your type of project.
4.2 On-Site Assessment
Before we can provide a final quote, we will visit your property in person to assess the work required. This assessment is free and does not obligate you to purchase services.
4.3 Written Quotes
After the on-site assessment, we will provide a written quote specifying:
- The scope of work to be performed
- The total price
- Payment terms
- Estimated start date and duration
- Any materials to be used
Written quotes are valid for thirty (30) days from the date issued unless otherwise stated. Prices may change after thirty (30) days due to fluctuations in material costs, labor availability, or seasonal factors.
4.4 Acceptance of Quotes
A quote becomes a contract when you accept it in writing (by email, text message, signed document, or electronic signature) and we confirm the acceptance. Verbal acceptance is not sufficient to create a binding agreement.
5. Service Area
Spiced Up provides services primarily within Bay County, Florida, including Lynn Haven, Panama City, Panama City Beach, Callaway, Parker, Springfield, and surrounding communities. We may decline to provide services outside our primary service area or may charge additional fees for travel. We reserve the right to modify our service area at any time.
6. Scheduling, Rescheduling, and Cancellation
6.1 Scheduling
Once you accept a quote, we will work with you to schedule your service. Scheduling is subject to our availability, weather conditions, and other factors.
6.2 Recurring Services
If you sign up for a recurring service (such as weekly, bi-weekly, or monthly lawn maintenance), your service will continue automatically at the agreed interval until you cancel in writing. Recurring service prices are subject to annual review and may increase upon thirty (30) days' notice.
6.3 Cancellation by Customer
- Individual service cancellation: you may cancel a scheduled one-time service with at least twenty-four (24) hours' advance notice without charge. Cancellations with less than 24 hours' notice may be subject to a $50 cancellation fee to cover scheduling and travel costs.
- Recurring service cancellation: you may cancel your recurring service plan at any time with written notice. Your service will continue until the end of the current billing period.

6.4 Cancellation by Spiced Up
We may reschedule or cancel services due to:
- Weather conditions that make the work unsafe or unproductive (heavy rain, high winds, freezing temperatures, lightning)
- Property conditions that prevent us from completing the work (locked gates, aggressive animals, unmarked underground utilities)
- Customer non-payment of prior invoices
- Equipment failure or staffing issues outside our control
When we need to reschedule, we will contact you to find the next available date. We are not liable for delays caused by these circumstances.
7. Your Responsibilities as a Customer
To ensure we can provide the best service, you agree to:
- Provide accurate contact information, including your name, phone number, email, and property address
- Ensure safe access to your property on service days — unlocked gates, pets secured indoors, vehicles moved from the work area, and any obstructions removed
- Notify us in advance of any underground utilities, irrigation lines, invisible fences, sprinkler heads, buried cables, or other hidden infrastructure we should avoid
- Mark sprinkler heads, valve boxes, and other hidden fixtures before we arrive
- Provide water access if needed for certain services (planting, seeding, pressure washing)
- Pay invoices on time as specified in your agreement with us
- Communicate any concerns promptly so we can address them
8. Payment Terms
8.1 Invoicing
We will send you an invoice after each completed service or on the billing cycle specified in your service plan. Invoices are delivered by email or text message unless you request a different delivery method.
8.2 Accepted Payment Methods
We accept:
- Credit and debit cards (Visa, Mastercard, American Express, Discover)
- ACH / bank transfers
- Paper checks
- Cash
Online payments are processed securely by our payment processor.
8.3 Payment Due Date
Unless otherwise specified, payment is due within fourteen (14) days of the invoice date.
8.4 Late Payments
Accounts not paid within 14 days may incur a late fee of $25 or 1.5% of the outstanding balance, whichever is greater, charged monthly until paid in full. Accounts more than sixty (60) days past due may be suspended, referred to collections, or subject to legal action. You are responsible for reasonable collection costs and attorneys' fees if collection becomes necessary.
8.5 Refunds
We stand behind our work. If you are not satisfied with a completed service, contact us within seven (7) days and we will work to make it right — either by returning to redo the work, providing a credit toward future services, or issuing a partial refund at our discretion. Refunds are not available for:
- Services you cancelled less than 24 hours in advance
- Weather-related rescheduling
- Changes in your own plans after work has begun
- Services completed in accordance with the agreed scope
9. Warranty
9.1 Workmanship Warranty
We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. If a defect in our workmanship becomes apparent within thirty (30) days of service completion, contact us and we will correct the defect at no additional cost.
9.2 Plant and Material Warranty
For plants we install, we provide a limited ninety (90) day survival warranty from the date of installation. The warranty covers replacement of plants that die due to improper installation. The warranty is void if the plant damage is caused by:
- Improper watering by the customer
- Extreme weather events (freeze, drought, flood, hurricane)
- Pests, disease, or wildlife
- Physical damage from pets, people, or equipment
- Vandalism or theft
- Chemical application by someone other than Spiced Up
Warranty claims must be submitted in writing within the warranty period and may require an on-site inspection.
9.3 Hardscape Warranty
Hardscape installations (patios, walkways, retaining walls) carry a one (1) year warranty against defects in workmanship, subject to proper use and normal wear. The warranty does not cover settling due to soil conditions beyond our control, damage from roots, or damage from impact or vehicle traffic.
9.4 Warranty Claims
To make a warranty claim, contact us at (850) 896-2739 or [email protected] with a description of the issue and photographs if applicable. We will respond within seven (7) business days.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- We are not liable for damage to underground infrastructure (sprinklers, wiring, pipes, cables, septic lines, invisible fences) that was not clearly marked or disclosed to us in advance.
- We are not liable for damage caused by weather, acts of God, pests, disease, theft, vandalism, or other conditions beyond our reasonable control.
- Our total aggregate liability for any claim related to a specific service is limited to the amount you paid us for that specific service.
- We are not liable for incidental, consequential, indirect, or punitive damages, including loss of profits, loss of use, loss of property value, or emotional distress, even if we have been advised of the possibility of such damages.
These limitations do not apply to:
- Liability that cannot be excluded under applicable law (including gross negligence, willful misconduct, or personal injury caused by our negligence)
- Claims for non-payment of fees owed by Spiced Up to you (such as refunds we owe you)
11. Communications Consent
By providing your phone number and email address to Spiced Up, you consent to receive communications from us about your estimate, scheduled services, invoices, promotional offers, and customer service matters. You can opt out of marketing communications at any time by replying STOP to any text message, clicking the unsubscribe link in any marketing email, or contacting us directly. 12. Website Use
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorized access to our systems or accounts
- Transmit viruses, malware, or harmful code through our website
- Impersonate another person or business
- Scrape, copy, or harvest content from our website for commercial use without permission
- Interfere with the operation of our website or the servers that host it
We reserve the right to restrict or terminate access to anyone who violates these rules.
13. Intellectual Property
All content on our websites — including text, images, logos, designs, photographs of our work, testimonials, and branding — is the property of Spiced Up Lawn Service LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and share our content for personal, non-commercial purposes, but you may not copy, modify, reproduce, distribute, or use it for commercial purposes without our written permission.

14. Third-Party Services and Links
Our websites may contain links to third-party websites, products, or services (such as social media profiles, supplier websites, or our marketing partner Iron Automations). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is at your own risk and subject to their terms.
15. Disputes and Governing Law
15.1 Informal Resolution
If you have a complaint or dispute, please contact us first at (850) 896-2739 or [email protected]. We will work with you in good faith to resolve the issue directly. Most disputes can be resolved quickly through direct communication.
15.2 Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws principles.
15.3 Venue
Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Bay County, Florida, and you agree to submit to the personal jurisdiction of those courts.
15.4 Statute of Limitations
Any claim arising out of or relating to our services must be filed within one (1) year of the date the claim arose, or it is permanently barred.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. For material changes, we will notify you by email or by a prominent notice on our website. Your continued use of our services after the update constitutes acceptance of the revised Terms.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Spiced Up regarding our services and supersede all prior or contemporaneous agreements, communications, and proposals.
17.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed from these Terms and the remaining provisions will remain in full force and effect.
17.3 Assignment
You may not assign these Terms or any rights under them without our written consent. We may assign these Terms at any time without notice or consent.
17.4 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
17.5 Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, weather, natural disasters, pandemic, war, terrorism, civil unrest, labor disputes, supply chain disruptions, or government action.
17.6 Independent Contractor
Spiced Up is an independent business. These Terms do not create a partnership, joint venture, employment, or agency relationship between you and Spiced Up.
